Forensic Accounting in High-Stakes Litigation

Chris Davis of Financial Evidence Group is grateful for another opportunity to serve as a forensic accounting expert in high-stakes litigation matters.


First, congratulations to plaintiffs’ co-counsel and their clients in Giuseppe Pampena v. Elon R. Musk. On March 20, 2026, a San Francisco jury found that Elon Musk committed securities fraud in connection with his $44 billion acquisition of Twitter. Reported damages were estimated between $2.1 and $2.6 billion, making it one of the largest recent jury awards in a securities fraud case. Chris had the privilege of assisting plaintiffs’ counsel at Cotchett, Pitre & McCarthy, LLP and Bottini & Bottini, Inc.


As plaintiffs’ forensic accounting expert (separate from the damages expert), Chris prepared an expert report and testified in deposition. Her work focused on analyzing complex SEC filings and related source documents to reconstruct the evolution of Musk’s disclosed financing structure during the relevant period. The analysis included demonstrative timelines and financial modeling regarding the extent of additional TSLA sales that would have been required to complete the acquisition at the time of Musk’s May 13, 16, and 17, 2022 public statements.


As the case evolved and trial time became limited, Judge Charles R. Breyer determined that Chris' live testimony was not necessary at trial on the issue of motive evidence. Even so, Chris was pleased that the underlying analyses and demonstratives supported counsel’s trial preparation and presentation. Hearing from counsel that the work was “invaluable” was especially meaningful.


Forensic accounting in litigation requires more than technical accounting knowledge. Effective expert analysis often depends on the ability to translate complex financial records, SEC disclosures, valuation issues, and transactional data into clear, defensible opinions aligned with the governing legal theories and evidentiary framework of the case.


In closing, this was an exciting case to work on. Chris could not be more pleased to have been a part of an excellent team of attorneys and professionals that helped these plaintiffs obtain this exceptional outcome.
